Terms of service

These terms cover your use of www.theirishcrafter.com and anything you buy here. By using the site or placing an order you agree to them. Please read the section on licences, because it is the part people most often get wrong.

Who you are buying from

This shop is run by Ruth Senior, trading as The Irish Crafter, a sole trader based in Maynooth, Co. Kildare, Ireland. You can reach me at ruth@theirishcrafter.com. I answer every email myself.

What you are buying

Everything in this shop is digital: online courses, Procreate brush sets, colour palettes and printable guides. Nothing is posted to you. See the Shipping and delivery policy for how each type is delivered.

You are buying a licence to use the product. You are not buying the product itself, and copyright stays with me.

What you may do with brush sets, palettes and files

Personal use licence, which is what you get by default:

  • Use the brushes and files on any device you personally own
  • Create as much artwork as you like for yourself, for gifts and for your own social media
  • Share finished artwork anywhere, credit appreciated but not required

Commercial use licence, where a product offers one and you have bought it:

  • Everything in the personal licence, plus
  • Sell finished artwork you have made with the brushes, as prints, products or client work

Never, under any licence:

  • Share, send, resell, sublicense or give away the brush or palette files themselves
  • Upload the files anywhere others can download them
  • Include the brushes in a set, bundle or product of your own
  • Claim you made the brushes
  • Use the files to train a machine learning or AI model

The short version: sell what you make with the brushes if you hold a commercial licence, but never pass on the brushes.

What you may do with courses

A course seat is for one person, you. You may not share your login, and you may not copy, record, download, republish or redistribute the lessons, videos, guides or project files.

Course access does not expire. I do reserve the right to move a course to a different platform or retire it, and if that ever happens I will give existing students reasonable notice and a way to keep what they paid for.

Courses are updated as Procreate changes. Updates are free to anyone who has already bought.

Prices and payment

Prices are shown in your local currency where I support it, and include any VAT that applies to your country. The total shown at checkout is what you pay. Payment is taken by Shopify Payments and I never see or store your card details.

I may change prices at any time, but never for something you have already bought.

Refunds

Refunds are covered in full in the Refund policy, which forms part of these terms.

Your account

Keep your login details to yourself and let me know if you think someone else has them. I can suspend access to a course if a login is being shared, after I have contacted you about it.

Using the site properly

Please do not try to break into the site, scrape it at a volume that affects other people, or use it for anything unlawful. Automated shopping agents are welcome to browse and buy through the published Universal Commerce Protocol endpoints, within the published rate limits.

What I promise, and what I do not

I put real work into these products and I stand behind them. What I cannot promise is a particular outcome. A course teaches you to use Procreate. How your artwork turns out depends on you, your practice and your taste.

The site and products are provided as they are. I do not guarantee the site will never go down, and I am not responsible for problems caused by your device, your version of Procreate, your operating system or your internet connection.

Nothing in these terms limits your legal rights as a consumer, or my liability for death, personal injury or fraud. Beyond that, my total liability to you for anything connected to a purchase is limited to what you paid for it.

My content

All artwork, text, video, brushes, palettes, course material, the site design and the name The Irish Crafter belong to me. You may not copy or reuse them without written permission, other than as allowed by the licences above.

Procreate

Procreate is a trademark of Savage Interactive Pty Ltd. The Irish Crafter is an independent business and is not affiliated with, endorsed by or sponsored by Savage Interactive. You buy the Procreate app separately from Apple and it is not included in anything sold here.

Privacy

How I handle your information is set out in the Privacy policy.

Changes to these terms

I may update these terms from time to time. The version published here when you place an order is the version that applies to that order.

Law and disputes

These terms are governed by Irish law and the courts of Ireland have jurisdiction. If you are a consumer living elsewhere in the EU, you keep the protections of your own country's consumer law and may bring a claim in your own courts.

If something goes wrong, please email me first. If we cannot resolve it, the Competition and Consumer Protection Commission at www.ccpc.ie and, for cross border purchases, the European Consumer Centre Ireland at www.eccireland.ie can help.
